3. PURPOSE AND SCOPE OF THE T&Cs
These General Terms and Conditions of Sale and Use (the “T&Cs”) govern the conditions of access, use, and billing of the services offered by C2Care, whether free or paid.
Their purpose is to define the contractual rights and obligations between C2Care and any User who has subscribed to the Service, including in the case of free access to the platform.
Registering on the platform—whether through a free plan or a paid subscription—constitutes full, unconditional acceptance of these T&Cs, which are available at all times at:
https://www.c2.care/en/cgv-en/
These T&Cs prevail over any other document, communication, or purchase terms issued by the User.
C2Care reserves the right to modify these T&Cs at any time. The applicable version is the one in force at the date of Subscription or, in case of later changes, the version in force at the time of continued use of the Service by the User. Continued use constitutes tacit acceptance of the updated terms.
4. DESCRIPTION OF THE SERVICES PROVIDED
The Service includes:
- Access to a software platform offering virtual exposure to immersive environments,
- Artificial intelligence (AI) functionalities supporting the User,
- Optionally, the provision of compatible equipment,
- Optionally, video sessions with Partner Practitioners.
The Service is intended to support emotional wellbeing. It does not constitute medical treatment or a therapeutic act of any kind.
5. SUBSCRIPTION TERMS
Subscription to the Service may take two forms:
- Free access:
The User may access certain limited features of the Service at no cost. Registration implies full acceptance of these T&Cs. - Paid subscription:
The User may choose a paid plan, providing extended features, additional services (equipment provision, video sessions, etc.), with or without commitment. Subscription can be completed via https://app.c2.care or through a C2Care representative.
Plans involving the provision of equipment require a commitment period specified at the time of Subscription. All paid subscriptions automatically renew unless otherwise stated in the offer or quotation
6. USE OF THE SERVICE
The Service may be used:
- For oneself, as part of a personal emotional wellbeing journey;
- To support a third party, as part of a professional activity (e.g., a practitioner guiding clients through exposures).
Each User is responsible for the way they use the Service. The Service is not intended to diagnose, prevent, or treat any mental disorder. If unsure whether the Service is suitable, the User is advised to consult a healthcare professional.
The required equipment (VR headset, tablet, web browser) is indicated at the time of Subscription.
7. PROVISION OF EQUIPMENT
Some Subscription plans may include the provision of a virtual reality headset and its accessories. This equipment remains the property of C2Care for the entire duration of the subscription.
At the end of the commitment period, the User agrees to return the equipment within 14 calendar days, complete, functional, and in its original packaging, using the provided return label.
In the event of non-return, damaged equipment, or missing items, replacement fees may be charged to the User according to a price list available upon request.
Equipment is covered by a warranty only during the commitment period. Outside this period, in the event of malfunction, return shipping costs are borne by the User, and C2Care does not guarantee repair or replacement.
8. REMOTE SESSIONS WITH A PRACTITIONER
Two modes of use are available:
(a) Independent sessions between Users
A User may offer sessions to another User (e.g., a practitioner supporting their clients via the C2Care solution).
C2Care is not party to this relationship and is not responsible for scheduling, organisation, or any payments between Users.
(b) Sessions offered by C2Care
Some Subscription plans include remote sessions with a C2Care Partner Practitioner. These sessions:
- Must be booked by the User during the current monthly period,
- Are limited in monthly number (specified at Subscription),
- Cannot be carried over or refunded from one month to another,
- Must be cancelled at least 48 hours in advance.
9. PRICES, PAYMENT AND BILLING
Service prices are indicated at the time of Subscription, depending on the chosen plan and the User’s location. Prices may be shown in different currencies depending on residence or billing country.
Payment is made by credit card through a secure platform. The Service is billed according to the selected frequency (monthly or yearly), with an electronic invoice sent to the User.
Access to the free version of the Service incurs no billing, unless the User switches to a paid plan. Any upgrade to a paid plan immediately applies the pricing conditions in effect at the time of the change.
C2Care may adjust its prices at any time, without retroactive effect. Price changes apply to new Subscriptions and upon renewal of existing subscriptions.
10. RIGHT OF WITHDRAWAL
The User has a 14-day withdrawal period starting from the Subscription date, provided that:
- The Service has not been used,
- No session with a Partner Practitioner has been booked.
The request must be made in writing to: sales@c2.care.
If the right of withdrawal is exercised and equipment has been provided, the User must return the complete, unopened equipment at their own expense.
C2Care will issue a refund within 14 days.
11. INTELLECTUAL PROPERTY
All content, software, environments, and trademarks relating to the Service are the exclusive property of C2Care. Any reproduction, distribution, adaptation, or use outside the scope of the Service is prohibited without prior written authorization.
12. PERSONAL DATA AND CONFIDENTIALITY
C2Care places great importance on the protection of personal data. Data processing is carried out in accordance with applicable data protection regulations, including the General Data Protection Regulation (GDPR) for Users located in the European Economic Area.
For Users residing outside the European Union, C2Care applies GDPR confidentiality and security principles as data processing standards, unless local law requires otherwise.
The User may request access, rectification, or deletion of their personal data at any time via the website’s contact form. No information will be shared with third parties without prior consent.
Exchanges between Users and Partner Practitioners are strictly confidential and are not recorded.
13. USE OF ARTIFICIAL INTELLIGENCE
The Service includes artificial intelligence modules governed by the C2Care AI Usage Charter. These tools do not replace any medical diagnosis or treatment.
AI interactions (AI coach, virtual characters, etc.) are autonomous, non-medical, and designed to comply with principles of safety, transparency, and confidentiality.
The User retains full control over their data and may consult the AI Charter at any time.
14. SERVICE UPDATES AND CHANGES
C2Care may modify the content, features, or access to the Services at any time without prior notice. This includes adding or removing virtual environments or adapting to technological changes.
Minimum hardware requirements are specified at Subscription and may evolve.
15. LIABILITY AND LIMITATIONS
The Service is intended to support emotional wellbeing. It does not constitute a medical act, therapy, or emergency solution and cannot replace care provided by a healthcare professional.
In the event of temporary interruption, malfunction, or partial or total unavailability of the Service, C2Care cannot be held liable for any resulting consequences for the User. No compensation or financial indemnity will be provided. C2Care will make reasonable efforts to restore access as promptly as possible.
The User is solely responsible for how they use the Service, whether they access it free of charge or through a paid plan.
C2Care declines all responsibility in the event of:
- misuse of the Service or use that does not comply with its intended purpose,
- failure to consult a healthcare professional when necessary,
- psychological, emotional, or physical consequences resulting from exposure to immersive environments.
The Service cannot be used to manage critical or emergency situations. In case of emergency or distress, it is the User’s responsibility to immediately contact the appropriate emergency services in their country of residence.
16. FORCE MAJEURE
Neither party shall be held liable for failure to perform its obligations due to an event of force majeure as defined by French case law.
17. APPLICABLE LAW AND DISPUTES
These T&Cs are governed by French law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the Tribunal of Toulon, France.
